Terms of Use

1. Nature of the software

Oudi Koud (“the Software”) is developed by Oudina Labs LLC, USA (“the Developer”). It is a computer-aided tool for preparing diagrams, calculations, schedules, test sheets and control-logic suggestions. It is not engineering advice, a professional approval or seal, a certificate of conformity, or a substitute for a licensed engineer or authority where local law requires one. Every output is an automated suggestion that must be reviewed and verified before any work is carried out.

2. Direct safety of workers and the installing electrician

All risks to the worker, the installing electrician or anyone on site during installation, connection, testing, measurement, commissioning and maintenance (shock, arc flash, fire, burns, falls, rotating machines, residual voltage and others) are solely the responsibility of that person and their employer. The Software does not monitor the site or the real condition of installations and cannot prevent an accident.

You must apply the locally approved safe-work procedures, including for information the five safety rules: full isolation; securing against reconnection (lock and tag); verifying absence of voltage with a suitable instrument; earthing and short-circuiting where required; and marking and protecting the work area from adjacent live parts. You must use personal protective equipment and calibrated, suitable instruments. [Verify local procedures]

3. Accuracy of inputs

All results depend on data you enter. Default and suggested values are provisional and illustrative, not legal limits. You alone must verify every value against manufacturer data sheets, actual measurement and the official texts in force in your country, in particular permitted currents, breaking capacities, resistances, lengths and voltages.

4. Limits of the automated checks

The checks are automated and partial, limited to the enabled rules and the data entered. The absence of a warning does not mean a design is safe or compliant. Risks the Software does not cover include (among others) derating for grouping and temperature, minimum short-circuit current at the end of a line, lightning protection, harmonics, actual wiring errors and functional-safety design. Results may contain software errors or assumptions unsuitable for your site. You must review every item and verify independently before execution.

5. Devices and components

Conformity of any device or component (breaker, contactor, controller, relay, cable, enclosure…) to standards, its suitability for the application, compatibility with others, installation instructions, certificates and catalogues are the responsibility of the manufacturer, the supplier and the electrician who selects and installs it. The Software does not verify the authenticity or conformity of any product; product data entered by you or by it is as entered.

6. Standards and laws

Standards, laws, practices and voltages differ between countries and sites. The binding reference is the official text in force locally. Limits and factors marked “verify” or “default” in the Software have not been reviewed by a licensed professional and may not match your standard. Standards are copyrighted and may not be included.

7. Logic and programming (PLC / smart relays such as LOGO!)

Generated files, tables and packs (block lists, ST, ladder, test vectors…) are suggestions, not original project files approved by the manufacturers. Test them in the manufacturer's simulator and then on the device without load before any connection. The Software must not be used to design safety functions, emergency stop or any system requiring specialist certification; design those outside ordinary logic with a certified specialist. The Software does not connect to devices; transferring a program to a real device and running it is solely the operator's responsibility.

8. Artificial intelligence (if used)

AI output is a suggestion that may be wrong or omit something important and must not be relied on without rule-based verification and qualified human review. No project is sent to an AI service without your explicit consent; you are responsible for what you send.

9. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, ABSENCE OF ERRORS OR CONTINUITY OF OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. LIMITATION OF LIABILITY AND INDEMNITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER, PUBLISHER, PARTNERS AND PERSONNEL ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, DEATH, FIRE, DAMAGE TO PROPERTY OR EQUIPMENT, LOSS OF DATA, PROFITS OR BUSINESS, AND THIRD-PARTY CLAIMS ARISING FROM USE OF, INABILITY TO USE, OR RELIANCE ON THE SOFTWARE OR ITS RESULTS OR FILES, UNDER ANY THEORY OF LIABILITY. IF LIABILITY IS NEVERTHELESS FOUND, IT IS LIMITED IN TOTAL TO THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE EVENT, TO THE EXTENT THE LAW ALLOWS.

You agree to indemnify the Developer against any third-party claim, fine or cost arising from your use of the Software in breach of these terms or applicable law.

11. Prohibited uses

Do not use the Software alone for: functional-safety systems (SIL/PL) and emergency stop; medical devices; hazardous locations (ATEX / NEC Class-Division); aviation, transport and nuclear; medium and high voltage; or any application where an error could cause death or serious injury, unless fully and independently verified by a certified specialist.

12. Data and privacy

Project files are saved locally on your computer and belong to you. Nothing leaves your device except by your explicit action, apart from the version check described in the Privacy Policy. You are responsible for the confidentiality, protection and backup of your customers' and facilities' data.

13. Licence and updates

The licence is annual for updates; the last version released before expiry remains usable, and access to and export of your files is never blocked. Safety fixes may be distributed to everyone. Updating the Software or its rules does not retroactively correct documents already issued; reviewing them after each update is your responsibility. Older versions may be switched to export-only mode (open, save and export) when a newer version is required.

14. Governing law and venue

These terms are governed by the laws of the United States and the State of Wyoming, where the Developer is based, and its courts have jurisdiction, unless the law requires otherwise. If any provision is void or unenforceable, the rest remains in force and the provision is interpreted to the nearest enforceable form. Nothing excludes liability that the law does not allow to be excluded. [Proposed; to be confirmed by the Developer's counsel]

15. Testing organisation

CIGO TECH (Algeria) — Kerkoud Khalil — carried out functional trial testing only. This is not a warranty, approval, certificate of conformity or engineering review, and the testing organisation and its personnel have no liability for the Software, its files or its use; the exclusions and limits in these terms apply to it as to the Developer. The trial service line is for technical support only and creates no obligation to achieve any result.

16. Acceptance and changes

Acceptance occurs by clicking “I agree” or by using the Software after the terms are shown. Acceptance is recorded locally with version, hash and date. Any change alters the hash and requires new acceptance. If you do not agree, do not use the Software.

17. Representations of the electrician user

You represent that you: (a) are an adult (18 or older) and a qualified, licensed or legally authorised person for the electrical work you do in your country, or work under the direct supervision of one; (b) use the Software only as an assistive tool, and professional decisions, execution, signing, testing, commissioning and handover remain yours and your employer's; (c) verify every number, diagram and file before execution and obtain the required permits, approvals and official inspections; (d) tell your clients the limits of this tool; (e) do not treat the absence of a warning as proof of safety; and (f) keep backups of your work. Every paper or file you give to a client or authority is issued by you and is your responsibility.

18. What law does not allow to be excluded

Nothing in this agreement excludes or limits any liability or right that applicable law does not allow to be excluded or limited (including fraud, wilful misconduct, gross negligence, and death or personal injury caused by the Developer's negligence where the law forbids exclusion, and mandatory consumer rights in your country of residence). To the extent required by local law those rights remain, and the other terms apply to everything else.

19. Store, export and language

If you obtain the Software from the Microsoft Store, the Store's terms also apply; Microsoft is not a party to this agreement and is not responsible for the Software or its support. You must comply with applicable export-control and sanctions laws. All intellectual-property rights in the Software and logo belong to the Developer, and you receive a personal, non-exclusive, non-transferable licence to use it. If translations differ, the Arabic text prevails; this English text is a courtesy translation. Contact: support@oudinalabs.com.

20. Payment, subscriptions and renewal

This trial is free and has no automatic renewal. If paid licences or credits are offered later, purchase will be at your explicit choice; price, term, renewal and cancellation rules will be shown clearly before payment; you can cancel online the same way you bought; and refunds are given as the law requires. No marketing messages are sent without your consent, and each one carries a working opt-out link.

21. Notice for the United States and similar jurisdictions

Electrical work in the United States is governed by the National Electrical Code (NEC / NFPA 70), state and local laws, professional licensing and the Authority Having Jurisdiction (AHJ) at your site. The Software does not verify compliance with those texts, does not replace permits, inspections or approvals, and is not a certificate of conformity to NEC, UL or any other standard. THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER AND ITS TESTERS ARE NOT LIABLE FOR INJURY, DEATH, FIRE, PROPERTY DAMAGE OR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL LOSS ARISING FROM USE OF THE SOFTWARE OR ITS OUTPUT. THE SOFTWARE DOES NOT REPLACE A LICENSED ELECTRICIAN OR ENGINEER, NEC/AHJ APPROVAL, PERMITS OR INSPECTIONS. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW.
